Terms of Service

By accessing or using any services provided by Viralux Studios ("Viralux," "we," "our," or "us"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our services.

Viralux Studios provides automated SMS messaging and Google review management software for home service businesses. Our platform enables businesses to:

• Automatically respond to missed calls via text message within seconds.
• Qualify inbound leads through a structured text conversation.
• Send Google review requests to customers after job completion.
• Track lead follow-up activity and review acquisition from a central dashboard.

By opting in to SMS communications from Viralux Studios or any business using our platform, you acknowledge and agree to the following:

• Opt-in is required. You will only receive automated SMS messages after providing explicit written consent. Consent is never a condition of purchase or service.
• To opt out: Reply STOP to any message at any time. You will receive one final confirmation message, and then no further messages from that sender. This opt-out is permanent for that number and sending entity.
• For help: Reply HELP to any message, or contact support@viraluxstudios.com or +1 (844) 987-6543.
• Message frequency: Varies based on business configuration, typically 1–5 messages per inquiry or job.
• Rates: Standard message and data rates may apply based on your carrier plan. Viralux Studios does not charge separately for individual messages beyond your subscription.
• Carrier disclaimer: Carriers are not liable for delayed or undelivered messages.
• All messages are sent via registered A2P 10DLC numbers in compliance with CTIA Messaging Principles and Practices and applicable carrier guidelines.

To use our services, you must register for an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Notify us immediately at support@viraluxstudios.com if you suspect unauthorized access to your account.

You agree not to use our services to:

• Send unsolicited messages to individuals who have not consented to receive them.
• Violate any applicable law, regulation, CTIA guideline, or carrier acceptable use policy.
• Impersonate any person, business, or entity.
• Transmit harmful, fraudulent, misleading, threatening, or deceptive content.
• Distribute malware, phishing links, or other malicious content via SMS.
• Attempt to reverse engineer, decompile, resell, or sublicense any portion of our platform without express written permission.
• Probe, scan, or test the vulnerability of our systems or networks.

All software, branding, content, and materials provided by Viralux Studios are owned by or licensed to Viralux Studios and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use our services as described herein. No other rights are granted.

Viralux Studios charges a one-time setup fee and a recurring monthly subscription fee, as described on our pricing page. SMS usage beyond your plan limits is billed at metered rates. Recurring charges are processed automatically via Stripe. You authorize us to charge your payment method on file for all fees incurred.

All fees are non-refundable except as required by law or as explicitly stated in a separate agreement.

Our services are provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that results obtained will be accurate or reliable. Use of the service is at your sole risk.

To the maximum extent permitted by applicable law, Viralux Studios and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, loss of goodwill, or business interruption, arising from your use of or inability to use our services.

Our total aggregate liability for any claim arising out of or relating to these Terms shall not exceed the total amount you paid us in the three (3) calendar months preceding the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless Viralux Studios and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the services, your violation of these Terms, or your violation of any third-party rights.

We reserve the right to suspend or terminate your access at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to our users or third parties, or is otherwise objectionable. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination will survive.

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising under these Terms shall first be attempted to be resolved through good faith negotiation. If that fails, disputes shall be submitted to binding arbitration in Vancouver, BC, under the rules of the British Columbia International Commercial Arbitration Centre, unless prohibited by applicable law.

We may revise these Terms at any time. We will post the updated Terms on this page with a revised effective date and notify registered users by email at least 14 days before material changes take effect. Continued use of our services after the effective date constitutes acceptance of the updated Terms.
